CullenCollimore Wins Summary Judgment for Municipality

CullenCollimore prevailed on a motion for summary judgment in State Court where the plaintiff homeowners’ insurer sued a municipal water supply. The carrier claimed that the municipal water supply was responsible for approximately $150,000 in water damage when a water meter installed in the home failed, leading to significant flooding in the basement. The Court agreed that the plaintiff could not establish a breach of the standard of care by the municipality in its installation of the meter, or its operation of the water supply, as a cause of the alleged failure. All claims were dismissed.
