Joint effort yields summary judgment for City and its officer.
Cullen Collimore Shirley and Gallagher, Callahan & Gartrell combined efforts to secure summary judgment for the City of Dover and one of its officers in the Strafford County Superior Court. The Plaintiffs, representing the estates of two men killed in a single vehicle accident when the driver’s BMW crashed at high speeds, asserted that the accident was caused by a police officer who had attempted to pull the driver over. The Court accepted the defense argument that the officer did not owe a duty of care to fleeing suspects or their passengers and, as such, granted judgment to the Defendants. Plaintiffs have not appealed. Congratulations to Attorneys Brian Cullen and Matt Burrows on a successful outcome.
